Marion Municipal Building
Monday, January 23, 2023
A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, January 23, 2023 at the Marion Municipal Room.
Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

IN PERSON ATTENDANCE: Daren Arrington, Marion Code Enforcement Officer; Marcia Lonneville; Caryn Devlin, Marion Historian, David Fulvio, Town of Marion Attorney.
Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.
Supervisor Bender read the following statement:
If you are attending a Town Board Meeting and have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.
If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

Discussion:
Supervisor Bender introduced and welcomed Town Attorney, David Fulvio to the Town Board. Mr. Fulvio replaces Art Williams who is now a Wayne County Judge and no longer able to be the Town Attorney. Supervisor Bender invited Mr. Fulvio to stay for the Town Board meeting.
Councilman Lonneville gave an update regarding ARPA funds. The traffic light on Main Street has been converted to LED lights. The hope is to make the traffic light a flashing light on all directions between 10pm and 6am each day. The no turn on red sign has been removed and a decision was made not to replace it.
Councilman Lonneville spoke next in regard to the Town Hall. The drywall and painting is now done. Trim, ceiling and electrical work will happen in the near future. Stucco work on the outside of the building should take place sometime in April.
Councilman Lonneville next stated the Marion Town Park renovations have started. Demo has started on the bathroom. Painting has started and a resolution will be presented tonight to complete some electrical work in the pavilion. Councilman Lonneville would also like to replace the microwave and purchase a new two burner hot plate for renters to use in the kitchen. Councilman Lonneville also introduced Samantha & Justin Starkes. They will be selling concessions at the Town Board for the 2023 baseball season.
Supervisor Bender stated that she and Code Enforcement Officer, Daren Arrington met with Wayne County Sheriff, Robert Milby and Lt. Croft to discuss the problems residents are having on Daniel Drive. Residents are encouraged to write depositions when an issue arises. Councilwoman Herman asked if a special meeting could be held between the residents on Daniel Drive, the Marion Town Board and Sheriff Milby. Supervisor Bender stated she will work on setting up this meeting.
Code Enforcement Officer, Daren Arrington spoke next in regard to the burnt-out laundromat on North Main Street. Mr. Arrington has spoken to the owner of the building. The owner plans on demolition of the building sometime in February. No engineer report is needed because the building is being torn down. A permit will be needed for the demolition to begin. Town Attorney, Mr. Fulvio was not aware of this new development and spoke to the attorney of the building’s owner. Mr. Fulvio will now reach back out to the owners Attorney for more information.
Councilman Cramer spoke next in regard to the employee handbook. The handbook has not been updated since 2005. Starting February 27th, the Town Board will discuss a section of the handbook at each 4th Monday meeting of the month until all changes have been made. At that time, the handbook will be sent to the Town Attorney to review before adopting. Mr. Fulvio stated that he would provide the Town with any new state requirements so this could be added to the new handbook.
Councilman Cramer next asked about the Comprehensive Plan. Councilman Lonneville gave an overview of the process in which is needed to update the Comprehensive Plan. The Marion Planning Board starts the process by forming a committee made up of community members, board members and Planning Board members. The committee then makes recommendations on amendments that should be made. The Town Board approves the amendments after all changes have been reviewed. Supervisor Bender will speak to the Planning Board and ask that this process be started.

The following resolution was adopted
WHEREAS, the Town of Marion sent out and RFP to solicit proposals to upgrade electric in the Lodge; and
WHEREAS one estimate was received; and
BE IT RESOLVED, that the Marion Town Board awards the bid to Sean Baker, Shores Edge Electric LLC with an amount not to exceed $3984 to be expensed as follows:
71104.01.000.004 $3984
BE IT FURTHER RESOLVED, the Town Board directs the Clerk of the Board to give a copy of this resolution to Sean Baker, Ron Lonneville and the Principal Account Clerk.
Resolution #125-23 Authorize Public Hearing for Appropriation from Highway Equipment Reserve to Purchase Equipment

The following resolution was adopted
BE IT RESOLVED, the Marion Town Board Authorizes a public hearing to be held on Monday, February 13, 2023 at 6:30pm for appropriation from Highway equipment reserve; and
BE IT FURTHER RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Tim Boerman and the Principal Account Clerk.
Resolution #126-23 Payment of Claims
On a motion by Councilman Lonneville and seconded by Councilman Cramer

The following resolution was adopted
WHEREAS, the Marion Town Board has received and audited the following claims: now
BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.

Additional Citizens Comments:
Caryn Devlin spoke and would like to see the Town Attorney update the handbook and then have the Town Board approve it. The Town Board is not looking for this. The Town Board will make any necessary changes and then give the document to the Town Attorney to review before putting in place.
With no further business, on a motion by Councilwoman Herman and seconded by Councilman Lonneville, Supervisor Bender closed the meeting at 7:26pm.
