TOWN BOARD Meeting Notes

Monday, July 24, 2023
A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, July 24, 2023 at the Marion Municipal Room.
Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

LaVerne Bliek, Councilman
Ronald Lonneville, Councilman
Julie Herman, Councilwoman
Michael Cramer, Councilman – via phone
Absent:
IN PERSON ATTENDANCE: Caryn Devlin, Historian; Marcia Lonneville; John Lonneville.
Supervisor Bender asked everyone to stand and give the Pledge of Allegiance.
Supervisor Bender read the following statement:
If you are attending a Town Board Meeting and have not signed up for Public Participation Section of the Town Board Meeting pursuant to the rules which have been established (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.
If after the Town Board has finished their business, each person in attendance who wishes to speak will be given 3 minutes at the end of the meeting to speak on only topics discussed at the evenings meeting.

- ARPA
- Town projects
- Request from the United Church of Marion to utilize ARPA funds to remove a dangerous tree from the property.
- Cemetery letter
- Pothole Route 21 and Farnsworth Road
- Resident wanted the board to be informed that a pride flag was stolen at 4169 N. Main Street
- Employee Handbook
Citizens Comments: None at this time.
Town Board Discussion:
ARPA:
Councilman Lonneville stated that ARPA funds are going to be used to pave the walking path around the Town Park as well as sealing the Highway barn driveways. Highway Superintendent, Tim Boerman still needs to get this scheduled.
Councilman Lonneville next stated that the quotes are needed to run internet to the Marion Town Park. Councilman Cramer stated he will call Spectrum. Resident John Lonneville spoke up and stated it would be more cost effective to hire an independent company to run the fiber optic lines to the Town Park instead of Spectrum. Councilman Lonneville will get quotes for this project.
Town Projects:
Councilman Cramer stated he is in the process of completing a scope of work that is needed to complete the upstairs of the Town Hall for renovations. Once this is done, he will write up RFP’s in hopes to have the work done in October 2023.
Councilman Lonneville stated that John Cornell is behind and will start work on the new HVAC system at the Town Hall the 2nd week in August.
Councilman Cramer stated he is still getting quotes for new cameras at the Town Park.
Councilman Lonneville stated Decker Excavating did a great job on the drainage work at the Town Park. His question is – can this area be seeded and become a walking trail in the woods? Councilman Bliek stated he will speak to Tim Boerman regarding hydroseeding this new area.
Councilman Lonneville next stated the pot hole on the corner of Rt. 21 and Farnsworth Road has been repaired. Thank you Mr. Boerman for getting this done.
The Town Board next spent time reviewing the Town of Marion employee handbook.

The following resolution was adopted
BE IT RESOLVED, That the Marion Town Board authorizes a public hearing for Local Law #5-2023 to be held on Monday, August 14, 2023 at 6:30 pm; and
WHEREAS Local Law #1-2005 previously adopted, to change the term for the supervisor from 2 to 4 years was defeated on referendum by petition and never took effect; and
AND BE IT FURTHER RESOLVED, that the Town Board of the Town of Marion authorizes the Clerk to the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #707-23 Authorize the use of ARPA Funds for Tree Removal at the United Church of Marion.

The following resolution was approved.
WHEREAS, the Town of Marion authorizes the use of ARPA funds for a dangerous tree to be removed at the Marion United Church located at 3848 North Main Street;
WHEREAS, the Town of Marion received a letter requesting the use of this fund not to exceed $2,500
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Marion United Church and the Principal Account Clerk.
Additional Citizen Comments
John Lonneville spoke and stated he was glad the town approved the ARPA funds for the tree removal at the United Church. The tree is a safety issue as many students walk through the parking lot on their way to and from school.
Executive Session
On a motion from Councilwoman Herman and seconded by Councilman Cramer, the Town Board moved into executive session at 7:01pm to discuss employment history of a particular person.
On a motion from Councilwoman Herman and seconded by Councilman Lonneville, the executive session was closed at 7:25pm.
With no further business, on a motion by Councilman Bliek and seconded by Councilwoman Herman, Supervisor Bender closed the meeting at 7:26pm.
