A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, February 12, 2024 at the Marion Court Room.

Supervisor Johnson called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Supervisor Johnson asked everyone to stand and give the Pledge of Allegiance.

Supervisor Johnson stated the Town Board made a decision to change the procedures on speaking at a Town Board meeting.  The following was read.

The Marion Town Board will allow anyone who would like to speak for 3 minutes each with a maximum of 15 minutes of the meeting devoted to citizens’ comments.  There will be time allocated at both the beginning and the end of the meeting.

Discussion:

  1. Drainage

Councilwoman Herman stated a tentative meeting has been scheduled for the Drainage committee.  The meeting is currently scheduled for March 6, 2024.  Councilman Cramer will also be attending this meeting.

  1. Traffic Light

The stop light in town has been upgraded.  Supervisor Johnson has spoken with Highway Superintendent, Tim Boerman.  Mr. Boerman recommends the light be programed to flash red in all directions from 9pm to 5am.

  1. Gym Time

Supervisor Johnson stated this discussion is taking place due to a variety of recreation programs trying to use the Marion Elementary school gym.  Supervisor Johnson stated she has had many conversations with the school district.  These conversations have been with Superintendent, Dr. Ellen Lloyd and Athletic Director, Lori DeLyser.  The understanding is that the gym is reserved on a ‘first come, first serve’ bases.  Supervisor feels this is an unfair practice and the school needs to “fix” the problem. Supervisor Johnson also stated that she feels the high school gym should also be available for different groups to use.  The bigger question is should youth or adults have more precedence over gym time.  Councilwoman Taber asked that everyone keep in mind that adult programming is just as important as kids.

Supervisor Johnson also stated she has reached out to the President of the Marion School Board for some clarification and is waiting to hear back from them after tonight’s School Board meeting.  Supervisor Johnson also stated she feels it is ridiculous that people are fighting to schedule program time.

  1. Porta Potties – Solar Eclipse – Events Organization?

Three porta potties were rented in the Fall of 2023 to be placed at the Town Park on April 8th for the Solar Eclipse.  The Town Board discussed this and decided only 1 porta potty at the Town Park in the back of the park.  Clerk of the Board, Heidi Levan will cancel two of the porta potties scheduled to arrive.

  1. Senior Citizen Request for funds – Esther Hutt

The Town Board discussed the Marion Senior Citizen group and decided because no money was allocated for this group for 2024, the request is denied for 2024.  The Town Board suggests the Marion Senior Citizen group attend a board meeting in August and make a request for 2025.  Supervisor Johnson stated that New York State in their executive budget has eliminated funds for senior citizens.

  1. Community Calendar

Councilman Lonneville read a statement on the importance of the Marion Community Calendar.  Currently, Councilman Lonneville and Nadine Seppeler, 2nd deputy Town Clerk have been delivering calendars.  Ms. Seppeler has taken a full-time job at the Walworth Town Clerk’s Office and will not be able to deliver calendars.  Councilman Lonneville has been having some walking issues and can no longer delivery the calendars by himself anymore.  Councilman Lonneville asked that all board members help deliver the calendars and talk directly to the business owners.

  1. Risk Assessment – The Bonadio Group

The Town of Marion has received the final report from the New York State Comptrollers office regarding the case against the former Marion Court Clerk.  The report suggested that the Town of Marion hire an outside audit group to audit the books of the Marion Court System.  The Town Board has determined that an audit is necessary.  Councilman Cramer suggested that the Marion Library be audited as well.  The Town Board agreed.

  1. Girl Scouts

Town Clerk, Heidi Levan stated that the Marion Girl Scouts will be using the parking lot at the Marion Town Park on February 28, 2024 to sort cookies.  This is an annual event and is greatly appreciated by all who participate.

  1. Cemetery

Councilwoman Herman provided the Town Board with a draft copy of the final audit conducted by the New York State Division of Cemeteries in regard to the Marion Cemetery Association.  The Marion Cemetery Association dissolved on December 31, 2023 and was conveyed to the Town of Marion. Councilwoman Herman is still waiting on the actual final report however at this time, it looks like the Town of Marion will be able to spend the Perpetual Care Funds that the Marion Cemetery Association has not had access too.  More information will be presented to the Town Board once it is complete and given to the Town.

  1. Civic Rec Software

Supervisor Johnson presented the Town Board members with a copy of a proposed software program titled CivicRec Software.  The program would be used to streamline scheduling of recreational programs, Town Park rentals and potentially the Marion Library’s community room.  Supervisor Johnson went onto say that the Town of Walworth currently uses this program, and their recreation department was nothing until this program was used.  Supervisor Johnson also stated that the Town of Marion did receive a grant from Wayne County Aging and Youth to be used for one year for the Marion Summer recreation.  This grant was written by Dr. Ellen Lloyd, Superintendent of the Marion Central School District and Town Clerk, Heidi Levan.  Supervisor Johnson stated that the School District will not be using the $5,000 administration amount from the grant and would like to use this $5,000 to go towards the software program.  Supervisor Johnson will also share this information with Town Clerk/Clerk of the Board, Heidi Levan to be added to the meeting information.

Town Business: 

  1. Town Projects

Councilman Lonneville stated that the emergency steps out the Court Room back door should be installed this week.

Councilman Lonneville also stated that the furnace at the Town Park is being installed by John Cornell and will be completed by early spring.  The sinks at the Town Park have been installed and tested and bids to upgrade the flooring are due this week.

Councilman Lonneville next stated that J & L contracting are finishing up trim at Jennie’s House (Town Museum) and the rooms are now ready for displays.

  1. Other Business

Councilman Lonneville stated that he has been working with RG & E and other contractors regarding turning off the lights at the Town Park during the Total Solar Eclipse event at the Town Park.  Some lights can be turned off but the majority of them can not.

Councilman Cramer thanked Town Clerk Heidi Levan and Marion School Superintendent,            Dr. Ellen Lloyd for working together to apply for the Summer Recreation Grant.

Councilman Cramer next thanked Joan Fisher and Barb Schoonerman for their    continued support with the Adult Recreation programming.

Councilman Cramer next thanked Councilwoman Taber for taking the role of liaison for the Marion Park & Recreation programs, Councilwoman Herman for her continued work with the Marion Cemetery and Councilman Lonneville for is project management skills and making sure all town projects are complete.

Citizens Comments:

Nancy & Keith LaFevre spoke first in regard to flooding that occurred on Buffalo Street.  The LaFevre’s feel this is due to drainage work that was done at the Marion Town Park last year.  The LaFevre’s contacted Supervisor Johnson with NYS DEC laws in regard to drainage.  The Town Board asked Supervisor Johnson for a copy of that information.

Barb Schoonerman spoke next regarding Adult Pickleball.  Ms. Schoonerman is a life long resident and the co-facilitator of the Marion Adult Recreation and supports the efforts of the Town Board to allow adult recreation.  Ms. Schoonerman also stated she feels that no group should be given priority over another group to utilize the school gyms and went onto say, the custodian staff only works until 9pm and if a group uses the gym after hours, facilities use fee would need to be paid.  Ms. Schoonerman also stated that there are no pickleball courts at the Highschool so the Elementary school is the only place they can play at this time.  Ms. Schoonerman went onto say that the current Marion School Athletic Director is retiring in June and the new Director may have different ideas on how the schools gym rentals be handled.

Kate Robinson spoke next regarding the Marion Youth Recreation Basketball program.  Ms. Robinson is the coordinator of this program as well as a resident.  Ms. Robinson stated she is in favor of youth being given gym time over adults.  The basketball program has grown and grades 3,4,5 & 6 all play basketball and sometimes there are 3 teams in the gym at once due to limited availability.

Eliza Weis spoke next.  Ms. Weis is a lifelong resident, school nurse and runs the girls youth basketball program.  Ms. Weis stated that having gym time after 8pm doesn’t work for young families and also stated the Town of Marion should be supporting youth athletics and recommended that a meeting be scheduled this summer for all athletics.

Sarah Griffin spoke next and advocated for use of the Highschool gym space.  Ms. Griffin volunteers with the Marion PTO and also has a hard time getting gym space.

Lee DeRidder spoke next.  Ms. DeRidder asked if anyone has approached the Marion School Board regarding the gym available issue.

John Lonneville spoke next and stated the Marion School District has no interest in working with the Town of Marion.  Mr. Lonneville next stated that the school district wasn’t even a part of the Marion Comprehensive Plan committee because it was to much work.

Supervisor Johnson:  Public Safety, Highway

Supervisor Johnson stated that the Marion Fire Department has a report, and it is in everyone’s packet.  Supervisor Johnson next stated that she is working with NYS Department of Transportation to have a crosswalk across Rt. 21 from Warner Road for school walkers.  In order to do this done, it might require a sidewalk.  More information will be provided to the Town Board once it becomes available.  Councilman Lonneville asked if the school buses at the elementary school could be loaded in the back of the elementary school and not in front of the building.

Supervisor Johnson next stated that a letter was received from John VanDorp and each board member was given a copy.

Highway Superintendent, Tim Boerman spoke next and stated the Marion Highway Department plowed 21 times in January.  The Highway Department has been busy cleaning, painting and repairing equipment.

Supervisor Johnson next stated she has been speaking with the Marion Town Attorney.  Supervisor Johnson was not pleased with the interviewing process and would like to be included on all interviews in the future.  A discussion followed this statement.

Councilman Cramer: Deputy Supervisor, Zoning, Planning, Cemetery

Councilman Cramer stated the Town of Marion has not had any Planning Board or Zoning Board meetings in 2024 and neither has the County Planning Board.  Councilman Cramer will report back to the board once this is complete.

Councilman Lonneville:  Water, Sewer, Assessor, Code Enforcement

Councilman Lonneville met with Assessor Mike Rados and Adrienne Compton and everything is going well in the Assessor’s office and their report is in the Board packet.

Councilman Lonneville next stated that Code Enforcement Office, Daren Arrington is finishing up his training.

Councilman Lonneville next stated that the Marion Historic Assocation met at the Marion Town Hall last Thursday (February 8, 2024).  The Historic Assocation will be starting to move the collection from the Town Hall to the museum on February 22, 2024.

Councilman Lonneville wanted to take a moment and thank 2nd Town Clerk Deputy, Nadine Seppeler on an excellent job.  Ms. Seppeler has done a lot of great things in a short period of time for the Town.  She will be greatly missed.

 Councilwoman Herman: Town Clerk, Drainage, Historian

Town Clerk Heidi Levan spoke and stated that 86% of Town & County taxes have been paid and the collection is going smoothly.  Ms. Levan also stated that she is looking for a part-time 2nd Deputy Town Clerk to replace the current staff member, Nadine Seppeler.  Ms. Seppeler has taken a full-time Deputy Town Clerk position at the Walworth Town Clerks’ office.  Ms. Seppeler has done an exceptional job and will be greatly missed.  This is the second time the Town Clerk’s office has lost a staff member to another municipality for a full-time position with better pay.  Councilman Cramer asked if a full-time deputy might be a better fit given the additional cemetery responsibilities that have been given to the Town Clerk’s office.  Ms. Levan and Councilwoman Herman both stated this can be looked at during the 2025 budget talks in August.  There is not enough payroll funds to currently cover a full time deputy.

Councilwoman Herman next stated a drainage meeting has been tentatively scheduled and Ms. Seppeler will remain a Town employee – Drainage Committee clerk.  Councilwoman Herman also stated that in January we had snow that thawed as well as heavy rains that contributed to the flooding around town.  This topic will be discussed at the next Town Drainage committee meeting.

Councilwoman Taber:  Judicial, Library, Parks, Recreation

Councilwoman Taber started by saying that she and Councilwoman Herman spoke with Marion Court Clerk, Barb Griffin regarding clarification on the court reports.  Ms. Griffin is now providing list of court proceedings as well as a copy of the judge’s bank statements.  A question was raised if there should also be a bail report each month?  The Town will be conducting audits on the court and Councilman Cramer suggested this take place every other year and the Town Board does their own audit on the off years.

Councilwoman Taber next gave a report regarding the Marion Library.  Councilwoman attended the Library Board meeting in January.  Councilwoman Taber thanked the Marion Library Board for their dedication to the library.  Councilwoman Taber also stated that the Marion Library held their 2nd annual gingerbread house contest in December.  The Flynn Family won.  The Marion Angel Tree program that runs at the Marion Library served 84 children in 2023.  More information regarding the library can be found on their Facebook page.

Councilwoman Taber spoke next regarding Parks & Recreation.  Councilwoman Taber has been working with the Marion School District to collaborate and help to build back relationship between both the school and town.  Councilwoman Taber stated since taking office as a Town Board member, she has helped fill many positions for the Parks and Recreation departments.  Councilwoman Taber will also plan on holding a meeting in March to help build the Parks & Recreation team and get everyone on the same page.

Councilwoman Taber also asked that concession be talked about at the next board meeting.

BE IT RESOLVED, that the Marion Town Board Authorizes Highway Superintendent to attend 2024 School for Highway Superintendents

WHEREAS, the 79th Annual School for Highway Superintendents will be conducted at Ithaca College in Ithaca, New York on June 3-5, 2024.

THEREFORE BE IT RESOLVED, that the Marion Town Board authorizes Timothy Boerman, Town of Marion Highway Superintendent, to attend above mentioned School for Highway Superintendents, and

THEREFORE BE IT FURTHER RESOLVED, that the expenses incurred for registration, travel, lodging and meals will be paid by the Town of Marion and be appropriated from Account #A50104.01.000.016 at a cost not to exceed the budgeted amount.

AND BE IT FURTHER RESOLVED, that the Town Board directs the Clerk of the Board to give a passed copy of this resolution to Timothy Boerman, Highway Superintendent and the Account Clerk.

Resolution #211-24 Authorize the Code Enforcement Clerk to have General Code update the Town Code

 BE IT RESOLVED, that the Marion Town Board authorizes Summer Johnson to sign and accept the New York State Climate Communities Pledge to submit to the New York Smart Communities portal; and

BE IT RESOLVED, authorizes the Town Supervisor, Summer Johnson to be the main point of contact for this program; and

WHEREAS, we believe that our response to climate change provides us with an unprecedented opportunity to save money, and to build livable, energy-independent and secure communities, vibrant innovation economies, healthy and safe schools, and resilient infrastructures; and

IT IS HEREBY RESOLVED that Town of Marion, to reduce greenhouse gas emissions and adapt to a changing climate, adopts the New York State Climate Smart Communities pledge, which comprises the following ten elements:

 Build a climate-smart community.

  • Inventory emissions, set goals, and plan for climate action.
  • Decrease energy use.
  • Shift to clean, renewable energy.
  • Use climate-smart materials management.
  • Implement climate-smart land use.
  • Enhance community resilience to climate change.
  • Support a green innovation economy.
  • Inform and inspire the public.
  • Engage in an evolving process of climate action.

Resolution #224-24 Authorize the Town of Marion to Purchase a Time Clock for the Cemetery

BE IT RESOLVED, that the Marion Town Board authorizes the Town Hall to purchase a time clock for the Cemetery; and.

WHEREAS, the Town of Marion acquired the Cemetery effective January 1, 2024; and

WHEREAS, the Lawn Care/Maintenance employees are required to punch a time clock; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #225-24 Amend Resolution #1211-23, #1003-23 and #510-23 Award Contract to Shores Edge Electric to Complete the Electric Upgrades needed to Renovate the Kitchen at the Town Park

Tabled on a motion from Councilwoman Herman and seconded by Councilman Cramer and approved with all ayes.

WHEREAS, the Town of Marion sent out an RFP to obtain bids to renovate the kitchen at the Town Park; and

WHEREAS, the Town of Marion received 2 bids; and

BE IT RESOLVED, that the Marion Town Board amends the contract to Shores Edge Electric, to complete the electric upgrades needed to renovate the kitchen at the Town Park with a change order to include heating hookups in order to upgrade the furnace increased amount of $1,143.00 for a total amount not to exceed $7,483.00 to be expensed from park reserve funds; and.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Shores Edge Electric and the Principal Account Clerk.

 Additional Citizen Comments

 Gina Southcott spoke and stated she had called the Town of Marion about a month ago for a skinned animal that was left in the ditch in front of her home on Farnsworth Road.  The Town Clerk’s office made arrangements with the Marion Highway Department to come out and remove the animal.  Ms. Southcott was grateful for the quick response, however since the original call, she has found two more animals and would like to know where to report them.  Town Clerk Heidi Levan stated she will provide a phone number to the NYS DEC to Ms. Southcott.

 Executive Session

 The Town Board went into executive session to discuss the employment history of a particular person on a motion by Councilwoman Herman and seconded by Councilman Cramer at 8:20pm.

With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Johnson closed the meeting at 9:15pm.
