A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, November 25, 2024 at the Marion Court Room.
Supervisor Johnson called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Resolution #11082024 Authorize Advertising for Board of Assessment Review

The following resolution was adopted
WHEREAS, a vacancy exist on the Board of Assessment Review; now
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to advertise the following in the legal newspaper for the Town of Marion:
“The Town of Marion is accepting letters of interest for the Board of Assessment Review. Letters may be directed to Supervisor Summer Johnson and will be accepted until December 20, 2024. For further information contact Supervisor Summer Johnson at sjohnson@townofmarionny.com”
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #11092024 Authorize Samuel T. Silco as Out of District Water User to Water District 1 Ext 2.

The following resolution was adopted
BE IT RESOLVED, that the Marion Town Board authorizes and approves the request made by Samuel T. Silco of 3318 Parker Rd. Marion, NY 14505, Tax Parcel 65113-00-043946, to become an Out-of-District Water User to Marion Water District 1 Ext 2, pending approval by the Town of Palmyra, WCW&SA, and receipt of a signed Out-Of-District Water User Contract with the Town of Marion; and
BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the following contract with Samuel T. Silco:
OUT -OF-DISTRICT WATER USER CONTRACT TOWN OF MARION
The undersigned, Samuel T. Silco, being the owner(s) of premises at 3318 Parker Rd. Marion, NY, Tax Parcel # 65113-00-043946, herein requests permission to connect to the existing water system Marion WD 1 Ext 2, and extend water service to the premises subject to the following terms and conditions:
- All work shall be performed in compliance with the Rules and Regulations of the Town of Marion, Wayne County, New York.
- The owner (s) herein acknowledge that municipal water is being supplied to him/her on an emergency basis and despite the fact that said premises are located outside the boundaries of Water District 1 Ext 2 in order to enhance the health and welfare of the residents of the premises.
- The Owner herein further acknowledges, for himself and his successors in title, that the extension of water service to the premises as aforesaid is temporary in nature and that said water service will be discontinued by the Town of Marion in the event that the premises are included within the boundaries of a new water district or within the boundaries of an extension to Marion Water District 1 Ext 2 at any time in the future.
- The Owner agrees to allow access to the premises at all reasonable times for purposes of reading the water meter and for purposes of making any repairs to the water service.
- The Owner herein agrees to pay any hook-up charges and the cost of water used or consumed on the premises. Failure to pay any charges so imposed will cause the water supply to be shut off by the Town or its designated agents. The Owner further agrees to sign a Memorandum of this agreement to be filed, if the Town so elects, in the Wayne County Clerk’s Office.
- The rate to be charged for water shall be the rate charged all water customers within Water District 1 Ext 2, as billed by the Wayne County Water and Sewer Authority. In addition, the Owner acknowledges that he shall also be charged, as additional water rent, an annual sum equal to the annual rate paid for debt service by residents of Marion Water District 1 Ext 2 which sum shall be levied and included on the Owner’s Town and County tax bill.
- In addition to the costs and expenses referred to above, the Owner shall also be responsible for the payment of all connection charges and meter rental, and for the installation of a Meter Pit, if required, and for the installation of a private waterline from the curbcock to the Owner’s residents, together with the costs associated with the installation of a standard back flow prevention device.
- The Owner acknowledges that he must comply with all applicable rules and regulations imposed by either the Town of Marion or the Wayne County Water and Sewer Authority with respect to the installation and maintenance of said water service, and further acknowledges that any obligation of the Town hereunder to furnish water to the subject premises shall at all times be subject to and contingent upon the Town’s ability to obtain an adequate supply of potable water.

Increase unit charge for the Regional Water Tank:
from $35.00626 to $36.04484/unit
BE IT FURTHER RESOLVED directs the Clerk of the Board to give a copy of this resolution to the
