A Town Board meeting of the Town of Marion, Wayne County, NY was held on Tuesday, October 10, 2023 at the Marion Municipal Room.
Supervisor Bender called the meeting to order at 6:28pm and asked the Clerk of the Board to give a roll call.

FURTHER NOTICE is hereby given that the Public Hearing will be held on Tuesday, October 10,2023 at 6:30pm at the Marion Municipal Building, 3827 North Main Street, Marion, NY 14505 at which time all persons will be heard in favor or against any items therein contained.

Supervisor Bender asked if anyone had any questions regarding the public hearing and the new Cannabis/Hemp Code for the Town of Marion. After asking three times and no one having any questions for concerns, the public hearing was closed on a motion from Councilman Cramer and seconded by Councilman Lonneville at 6:30pm.
Discussion:
Town Clerk Heidi Levan spoke regarding a proposed local law to allowing inserts to be placed in Town and County Tax bills. The Town Board stated this was a good idea. A public hearing will take place later in October.
Town Business:
- ARPA
Councilman Lonneville provided the Town Board with an updated ARPA expenditure list. Any questions regarding ARPA can be sent to Principal Account Clerk, Kathy Cauwels.
- Town Projects
Councilman Lonneville states the heating and air conditioning unit has been installed at the Town Hall and is working great. The work at the back of the Court Room will begin in the near future as well as a new emergency exit door.
- Budget
The Town Board discussed the Marion Budget.
Supervisor Bender stated that she and Councilman Bliek, Judge Bonafede, Judge Bender, Court Clerk Barb Griffin and Principal Account Clerk Kathy Cauwels had a phone meeting with the NYS Comptroller’s Office regarding court procedures. Supervisor Bender felt it was a good meeting.

Supervisor Bender: Assessor, Zoning, Planning
Supervisor Bender stated the Assessor has been busy and Assessor, Dawn VanPatten will be coming to the October 23rd meeting.
Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer
Councilman Bliek stated the new regional wastewater treatment plant located in Palmyra is ahead of schedule. Highway Superintendent, Tim Boerman stated the Highway Department has been busy mixing salt & sand, mowing road sides, tree work on Steurrys Road and helping Palmyra & Macedon Highway Departments with paving projects.
Councilman Lonneville: Historian, Public Safety
Councilman Lonneville stated the new traffic control panel is scheduled to be installed around December 15th. A big thank you to the Highway Department for installing the new ‘No turn on red’ sign on the corner of Buffalo Street and Main Street.
Councilman Lonneville also stated that Jennie’s House (Town museum) is in the process of painting the 2nd floor.
Councilman Lonneville & Historian Caryn Devlin stated that the Marion Historic Association ‘Haunting in the hamlet’ will be held this Saturday, October 14th. Please check the Marion Historic Association website for ticket information.
Councilwoman Herman: Parks, Recreation, Town Clerk, Library
Town Clerk Heidi Levan stated the Town Clerk’s office was busy with hunting licenses, school tax collection, as well as water and sewer payments. Ms. Levan thanked Deputy Kim Williams & Deputy Nadine Seppeler for all that they do for the Town of Marion, especially the Town Clerk’s office. The Office would not run as smoothly as it does without them.
Councilwoman Herman announced that Storytime has started again at the library.
Councilwoman Herman next stated she has been working with Town Clerk, Heidi Levan organizing a committee regarding summer recreation. A meeting is scheduled for Tuesday, October 24th. Councilman Cramer asked what the plan was for concessions for 2024. Councilwoman Herman stated she felt that food trucks should be brought in for concessions.

Councilman Cramer stated the CEO was busy and his report is in tonight’s meeting information.
Councilman Cramer next stated that a drainage meeting is scheduled for Tuesday, October 17th.

WHEREAS, a Public Hearing was held on October 10, 2023 to amend the Code of Marion to add Chapter 130 Cannabis; now
BE IT RESOLVED, Chapter 130: Cannabis
- 130-1 Authority
The adoption of this chapter is in accordance with Cannabis Law § 131, which expressly provides that the licensure and establishment of adult use cannabis retail dispensaries and on-site consumption sites shall not be applicable where a municipality adopts a local law requesting that the Cannabis Control Board prohibit the establishment of cannabis retail dispensary licenses and/or on-site consumption licenses within the jurisdiction of the Town of Marion
- 110-2 Title and Purpose
This chapter shall be known as and may be cited as “Local Law No. 6 of 2023 to Opt Out of Cannabis On-Site Consumption Sites”; and it’s purpose is to opt out of allowing on-site consumption sites in the Town of Marion.
- 110-3 Legislative intent and findings
New York State, through its Cannabis Control Board, has committed to implementing regulations governing the licensure and other related details for adult use cannabis retail dispensaries and on-site consumption sites, which are governed by newly implemented cannabis laws in New York. However, New York has failed to develop or provide such regulations at this time. Such regulations will provide context and insight into the details of licensure and operation of these establishments. While the regulation and impacts of retail dispensaries may be reasonably anticipated by considering, for example, the similar impacts of liquor/alcohol sales, there are fewer corollaries by which to asses on-site consumption sites, particularly given that they are likely to include on-site smoking of a controlled substance and given that the Clean Indoor Air Act otherwise prohibits indoor smoking in public spaces. The Town of Marion thus feels that it would be premature to permit on-site consumption sites in Town without first observing and understanding the regulations which will govern them. As such, the Marion Town Board hereby finds and hereby determines that, pursuant to Cannabis Law § 131, it shall out out of allowing cannabis on-site consumption sites that would otherwise be allowed pursuant to NY cannabis law at this time.

- 308-46: Special Permits
(14) Cannabis Retail Dispensaries in Marion (See §308-6, the definition of ‘Cannabis Retail Dispensaries’)
Cannabis retail dispensaries are only permitted in the A-C, B-1 and I-1 District upon the issuance of a special use permit. In addition to the special use permit procedures and standards set forth by Article IX herein, the issuance of a special use permit for a cannabis retail dispensary shall also require the following:
- A. State approvals. Any approval of a cannabis retail dispensary shall be conditioned upon obtaining any required state or governmental approvals, including but not limited to licensure by the NYS Cannabis Control Board.
- B. Increased Buffer. Licensed retail businesses engaging in the Transfer, Distribution, or Sale of Cannabis shall be a permitted use in any A-C, B-1 and I-1 District, provided that:
(1) Said licensed retail business engaging in the Transfer, Distribution, or Sale of Cannabis may not be operated within 500 feet of:
(a) A church, synagogue or regular place of worship.
(b) A public or private elementary, secondary school or licensed child day-care center.
(c) A boundary of any residence or residential zoning district.
(d) A public park.
(2) Said licensed retail business engaging in the Transfer, Distribution, or Sale of Cannabis may not be operated within 1,000 feet of another subject licensed retail business engaging in the Transfer, Distribution, or Sale of Cannabis or on the same lot or parcel of land as another adult use, as defined in Chapter 96 of the Code of the Town of Marion.
(3) A licensed retail business engaging in the Transfer, Distribution, or Sale of Cannabis may not be operated in the same building, structure or portion thereof containing an adult use, as defined in Chapter 96 of the Code of the Town of Marion, or another retail business engaging in the Transfer, Distribution, or Sale of Cannabis.
B-2. For the purposes of this chapter, measurement shall be made in a straight line, without regard to intervening structures or objects, from the nearest portion of the building or structure used as part of the premises where a retail business engaging in the Transfer, Distribution, or Sale of Cannabis is conducted to the nearest property line of the premises of a church or public or private elementary, secondary school or licensed child day-care center or to the nearest boundary of an affected public park, residential district or residential lot.
B-3. For the purposes of this chapter, the distance between any two subject licensed retail businesses engaging in the Transfer, Distribution, or Sale of Cannabis shall be measured in a straight line, without regard to intervening structures or objects, from the closest exterior wall of the structure in which each business is located.
- Hours of Operation. No cannabis retail dispensary shall operate outside the hours of 07:00AM (0700 Hours, EST) to 08:00PM (2000 Hours, EST) in the Town of Marion.

Resolution #1009-23 Declare Surplus 2002 Volvo EW 170 Excavator and 1995 Ford 1 Ton Dump Truck

BE IT RESOLVED, that the Marion Town Board awards the contract to High Expectations Construction and Landscaping, to complete the plumbing upgrades needed to renovate the kitchen at the Town Park with an amount not to exceed $5,910.00 to be expensed from park reserve funds; and.
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to High Expectations Construction and Landscaping and the Principal Account Clerk.

WHEREAS, the Town of Marion sent out an RFP to repair siding on the back of the Marion Court Building; and
WHEREAS, the Town of Marion received 1 bid; and
WHEREAS, the Marion Town Board awarded the contract to High Expectations Construction and Landscaping with an amount not to exceed $13,971.87 to be expensed out of 16204.01.000.050 – Building Renovations; and
WHEREAS, according to NYS code there must be an emergency egress, therefore, a fire escape door needs to be replaced; and
BE IT RESOLVED, that the Marion Town Board awards the contract to High Expectations Construction and Landscaping with an amount not to exceed $17122.99 to be expensed out of 16204.01.000.050 – Building Renovations; and.

Guideline #3 All estimated purchases of Less than $5,000 but greater than $1,000 require an oral request for the goods and written/fax quotes from 2 vendors; and
WHEREAS, the Town of Marion solicited for 2 quotes and received 1 quote; and
BE IT RESOLVED, that the Marion Town Board awards the contract to High Expectations Construction and Landscaping, to complete the painting of the 3 exterior doors at the Town Hall and the cages around the air conditioner and the generator with an amount not to exceed $1,566.90 to be expensed from 16204.01.000.050; and.

Resolution #1017-23 Authorize Supervisor to Sign all Necessary Documents to Apply for a Grant Through the Justice Court Grant Assistance Program

BE IT RESOLVED, that the Marion Town Board approves the submitting of an application for the Justice Court Assistance Program Grant (JCAP) replace and install new handicap accessible doors, new interior door, construction, window tint and office equipment for the Courtroom; and
BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign all necessary documents regarding said grant; and

BE IT RESOLVED that the Marion Town Board received a letter from Jeffrey Wagner regarding reducing sewer units from 2 to 1 for 3981 Buffalo Street as it has been converted from a two-dwelling to a one-dwelling home; and
BE IT FURTHER RESOLVED, The Code Enforcement Officer inspected the house and found the house to be in compliance with the Town of Marion building and zoning codes; and
BE IT RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Jeff Cragg, Wastewater Treatment Plant, Daren Arrington, Code Enforcement Officer, WCWSA, Jeffrey Wagner and the Principal Account Clerk.

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion as follows:

Local Law Number 7 for 2023 Town of Marion, County of Wayne, State of New York
A LOCAL LAW TO PERMIT CERTAIN MATERIALS TO BE ENCLOSED WITH REAL PROPERTY TAX BILLS.
The State of New York Tax Law, section 1826, requires that any insert such as a “notice, circular, pamphlet, card, hand bill, printed or written notice of any kind” be authorized or required by law to be included with the tax bill. At times the Town Board of the Town of Marion sees benefit to including notices with the tax bills that are sent out to all of the owners of real property in the Town. To permit the use of such inserted notices, the Town Board hereby adopts the following local law:
BE IT ENACTED by the Town Board of the Town of Marion, Wayne County, State of New York, as follows:
Section One: This Local Law is adopted pursuant to the provisions of the New York Municipal Home Rule Law.
Section Two: The Town Board of the Town of Marion elects to adopt this Local Law to permit the placement of enclosure notices with tax bills in the Town of Marion. This includes a legend printed on the tax bill or a separate document, insert, flyer, notice, circular, handbill, card, pamphlet or other information to be included with the tax bill. The term “tax bill” shall include the State County and Town Tax Bill as well as the School Tax Bill for properties within the Town of Marion. The Town Board of the Town of Marion, by resolution adopted by the Town Board, may direct that such notice be included with the tax bill in such form and manner as it may decide.
Section Three: EFFECTIVE DATE: This Local Law shall become effective immediately upon being filed in the Office of the Secretary of State.

BE IT RESOLVED, that the Marion Town Board hereby requests the following streets to be fully closed to all traffic on Saturday December 16, 2023 from 5:45p.m. – 7 p.m.
North Main Street from Park Drive to South Main Street, South Main Street from North Main Street to Mill Street, Newark-Marion/Mill Street from Smith Road to South Main Street; and
BE IT RESOLVED, that the Marion Town Board hereby requests the following streets to be closed but open to local holiday parade only on Saturday December 16, 2023 from 5:45 pm – 7p.m.
BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to E911, Marion Fire Department, Western Wayne Ambulance, Marion Fire District, Seneca Foods, Marion Post Office, Wayne County Highway Department, Wayne County Sheriff, NYS Police Substation, Williamson, Marion NY Community Betterment Organization, Chief Operator WWTP and Marion Highway Department.
The Town Board went into executive session to discuss the employment history of a particular person on a motion by Councilman Cramer and seconded by Councilwoman Herman at 7:20 pm.
With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Bender closed the meeting at 7:21pm.
