TOWN BOARD Meeting Notes

Marion Municipal Building

Monday, February 13, 2023

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, February 13, 2023 at the Marion Municipal Room.

Supervisor Bender called the meeting to order at 6:30 pm with a roll call done by Heidi Levan, Clerk of the Board.

Absent:                        Jolene Bender, Supervisor

IN PERSON ATTENDANCE: Caryn Devlin; John Lonneville; Ashley Tack; Angela Parker; Justin Starks; Samantha Starks.  Highway Superintendent, Tim Boerman was called and placed on speaker phone during the public hearing regarding Highway equipment reserves only.

Councilman Bliek asked everyone to stand and give the Pledge of Allegiance.

Public Hearing:

  1. Eligibility Levels Real Property Tax Exemption for Persons Over 65
  2. Appropriate from Highway Equipment Reserve

First Public Hearing regarding Real Property Tax Exemption opened up at 6:33pm.  The Clerk of the Board asked the audience if they had any questions or concerns, 3 times with no one asking any questions, the Public hearing was closed at 6:35pm on a motion from Councilman Cramer and seconded by Councilwoman Herman and approved with all ayes in the room.

The second Public Hearing regarding the appropriation from Highway Equipment Reserve fund opened at 6:35pm.  An attendee asked what a ‘Highway Reserve Fund’ was and why was it being used.  Councilman Lonneville explained what the funds were and how they can be used.  The Clerk of the Board asked if there were any more questions.  After asking 3 times with no one asking anymore questions, the Public Hearing was closed at 6:43pm on a motion from Councilman Cramer and seconded by Councilman Lonneville.

Discussion:

  1. Cyber Insurance

The Town Board discussed the Cyber Security Insurance proposal and asked to have insurance representative, Tim Cleary attend the next Town Board meeting to explain and discussed this proposal.  Clerk of the Board, Heidi Levan will ask Principal Account Clerk, Kathy Cauwels to arrange this meeting.

  1. Park Rules & Regulations Estimate – Heidi

Town Clerk, Heidi Levan presented the Town Board with updated Town Park rules and regulations for them to review.  The Town Board was happy with the updated paperwork.  Ms. Levan also asked to purchase corkboards, easels, and sign holders for the Town Park.  The board agreed to this, and Ms. Levan will order the needed supplies.  Councilwoman Herman spoke next on purchasing a ‘Hotplate’ and microwave for the main pavilion.  The Town Board agreed to this request.  Ms. Levan will also take care of ordering these supplies.

  1. Night Park Supervisor – Baseball

Councilwoman Herman spoke next regarding baseball, soccer and night park supervisor.  Ashley Tack will be the baseball coordinator but is unable to coordinate soccer due to other family commitments.  A discussion took place in regard to baseball/softball.  Ms. Tack asked the Town Board if the following information was ok.  T-Ball will be held one night a week and cost $40, Grasshoppers will be held two nights a week and cost $40, Travel Team will cost $75 and Softball will only be for U12 grades 3rd – 6th, no modified players will be allowed to play softball.  The Town Board was happy with all of this information.  The Marion Highway Department will prepare the fields.  Ms. Tack will look into registration dates and locations for registration.  Once all information is obtained, Town Clerk, Heidi Levan will post the information to the Town’s social media pages.

Town Business: 

 Councilman Lonneville reviewed the projects being completed within the Town buildings.  The Town Hall has painting that needs to be completed, ceiling to be hung, new lights and a window for the Assessor’s office.  The Town Park has the drywall hung in the ladies restroom, painting and plumbing to be completed in the near future.  Two new windows and ceiling fans will be installed this spring.

Councilman Lonneville spoke next regarding ARPA funds.  The Town Hall and Municipal rooms will soon be getting a new security system.  Councilman Lonneville is still waiting on Nutrien to decide if they will be donating a piece of land to the Town of Marion beside the Town Park.

Councilman Lonneville spoke next concerning the Town of Marion Comprehensive plan.  Councilman Cramer has asked if this could be updated, Councilman Lonneville stated he is still waiting on the Planning Committee to form a committee for this task.

Councilman Lonneville also asked when will the flowers on main street be ordered?

Citizens Comments:  Ashley Tack asked about a budget for baseball equipment and supplies.  Councilwoman Herman stated it was $3,000 for equipment and $850 for umpires.

Committee Reports:

Supervisor Bender:  Assessor, Zoning, Planning

Supervisor Bender did not attend the meeting, so no reports were given.

Councilman Bliek: Deputy Supervisor, Highway, Drainage, Water, Sewer

Councilman Bliek stated that there is nothing new to report for Water.  Councilman Bliek did state that the new joint Wastewater Treatment plant has broken ground in Palmyra.  Councilman Bliek stated the Highway Department has been busy working on equipment during this mild winter.  Drainage work has started at the Town Park.  Councilman Bliek also stated a new streetlight has been installed on the corner of Russell Rd. and East Williamson Road.

 Councilman Lonneville:  Historian, Public Safety

Councilman Lonneville stated the old burnt-out laundromat on North Main Street will be taken down in the new few weeks.  Councilman Lonneville also asked about a house covered in tarps on North Main Street that has not had any work done to it.  This is a safety hazard and needs to be addressed.  Councilman Lonneville has been working with Code Enforcement Officer, Darin Arrington to resolve this hazard. Councilman Lonneville next stated the electrical work at Jennie’s House is now completed and plumbing work is being done next.  Historian Caryn Devlin stated the Wayne County bicentennial will have opening ceremonies in Lyons on April 11, 2023.  There will also be a Gala on May 13th at Carey Lake in Walworth and tickets will soon be available for purchase.

Councilwoman Herman: Parks, Recreation, Town Clerk, Library

Town Clerk, Heidi Levan stated the Town Clerk’s Office is very busy collecting Town & County taxes and at this time, 85% of taxes have been collected.  Councilwoman Herman next stated the Marion Library had a water leak in the library due to a burst pipe.  Councilwoman Herman thanked the Marion Fire Department for their help removing water in the community room and Marion Sewer Department Chief Operator Jeff Cragg for his help coordinating clean up.  Mr. Cragg fixed the burst pipe in the wall.  Councilwoman Herman also stated that painting of the fascia on the Marion Library exterior needs to done.

Councilman Cramer:  Drainage, Judicial, Cemetery, Code Enforcement

Councilman Cramer stated that Marion courts have been steady and are starting to get busy again.  Councilman Cramer stated the first class of training for new Code Enforcement Officer, Daren Arrington has been completed, Mr. Arrington will take his test for this class on Wednesday, February 15th.  More training will be done in the near future.  Councilman Lonneville stated he has spoken to Daren Arrington in regard to 911 calls.  Mr. Arrington has now provided 911 with the correct phone number he can be reached at after hours.

Law, that the Town Board of the Town of Marion has duly held a public hearing on

the adoption of the following revised schedule of maximum income eligibility levels

for the Town real property tax exemption for persons sixty-five (65) years of age or

older;

BE IT RESOLVED, pursuant to Section 467 of the Real Property Tax Law, that the

following schedule of maximum income exemption eligibility levels is hereby

approved and adopted:

Resolution #205-23 Resolution to Authorize Highway Superintendent to Attend Advocacy Day 2023, Albany, New York

The following resolution was adopted

WHEREAS, the Advocacy Day Grass Roots Campaign 2023 will be conducted at the Albany Hilton Hotel in Albany, New York on March 7 and 8, 2023.

THEREFORE BE IT RESOLVED, that the Marion Town Board authorizes Timothy Boerman, Town of Marion Highway Superintendent, to attend above mentioned Advocacy Day Grass Roots Campaign 2023, and

THEREFORE BE IT FURTHER RESOLVED, that the expenses incurred for registration, travel, lodging and meals will be paid by the Town of Marion and be appropriated from Account #50104.01.0.016 at a cost not to exceed the budgeted amount.

AND BE IT FURTHER RESOLVED, that the Town Board directs the Clerk of the Board to give a passed copy of this resolution to Timothy Boerman, Highway Superintendent and the Account Clerk.

Resolution #206-23 Agreement to Spend Highway Funds

Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected for the repair of improvements on highways, and received from the state for repair and improvement of highways shall be expended as follows:

GENERAL REPAIRS.  The sum of $ 160,531.00   may be expended for general repairs upon  45.88 miles of town highways, including sluices, culverts and bridges having a span of less than five feet and boardwalks or the renewals thereof.

IMPROVEMENTS.  The following sums shall be set aside to be expended for the improvement of town highways:
