Monday, September 9, 2024

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, September 9, 2024 at the Marion Court Room.

Supervisor Johnson called the meeting to order at 6pm and asked the Clerk of the Board to give a roll call.

Supervisor Johnson asked everyone to stand and give the Pledge of Allegiance.

Supervisor Johnson welcomed all the Marion Highschool Students who were in attendance.

Budget Workshop: 6pm

Public Hearing:
1. Cable Television Agreement

The public hearing was opened at 6:30pm by the Clerk of the Board reading the legal notice.  Supervisor Johnson asked 3 times of anyone in attendance had questions and with no one coming forward, the public hearing was closed at 6:32pm on a motion from Councilman Cramer and seconded by Councilwoman Herman and all ayes.

  1. Local Law #3 Amendment and Reform to the Town of Marion Zoning Code Chapter 206,
    Sections 206-3 and 206-5.

The public hearing was opened at 6:33pm.  Supervisor Johnson asked 3 times of anyone in attendance had questions and with no one coming forward, the public hearing was closed at 6:34pm on a motion from Councilwoman Herman and seconded by Councilman Cramer and all ayes.

  1. Utilize Contingency Funds

The public hearing was opened at 6:35pm.  Councilman Lonneville provided some information regarding this public hearing.  Supervisor Johnson then asked 3 times of anyone in attendance had questions and with no one coming forward, the public hearing was closed at 6:36pm on a motion from Councilman Cramer and seconded by Councilwoman Herman and all ayes.

2. Live Streaming Public Meetings

Proclamation:
Acknowledging the Marion Historical Association.  The following Proclamation was read aloud by Supervisor Johnson.

Whereas, The Marion Historic Association began in April 1937, and revived in 1973 for the Bicentennial celebrations of the United State under the leadership of Carolyn Adriaansen; and

Whereas, Marion Town Board consisting of LaVerne Bliek, Linda Lee, Ken Hill, Bob Haak and Supervisor Jolene Bender passed a resolution in 2004 to purchase Jennie’s House located at 3794 S Main St, Marion, NY 14505; and

Whereas, The Marion Historic Association together with the Town of Marion’s Historian, Caryn Devlin and Marion Town Board; revived, restored and persevered Jennie’s House, its contents, and local history; and

Whereas, The Marion Historic Association commitment to honoring Marion’s past through events, speakers, and knowledge; and

Whereas, The Marion Historic Association and its board of directors continue to dedicate countless hours to the perseverance of history; and

Whereas, The Marion Historic Association along with past Town Historians, Emma Erdeli, and current Marion Town Historian, Jennifer Hunter wish to celebrate the grand opening of “Jennie’s” House.

Now, Therefore, I, Summer Johnson, Supervisor of the town of Marion and the current Town Board hereby recognize The Marion Historic Association, past Town Historians, and Current Town Historian, Jennifer Hunter for their positive contributions made to the Town of Marion, its community members and the greater goal of respecting and honoring history. This represents the “Spirit of Service” and should be looked upon as the example of commitment, honor, grit and care.

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign all necessary documents regarding said grant; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a certified copy of this resolution to the Justice Court Clerk and the principal account clerk

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

WHEREAS, the Marion Town Board held a public hearing on September 9, 2024; and

WHEREAS, a window is in need of replacement at Jennie’s house; and

BE IT RESOLVED, the Marion town board authorizes the repair of the window at Jennie’s house; and

BE IT RESOLVED, that the replacement of the window will not exceed $650 with the possibility of using the old trim. If new trim is needed that will be an additional cost not to exceed $200 to be expensed from 75204.01.000.042 utilizing contingency funds; and

BE IT FURTHER RESOLVED, the Town of Marion directs the Clerk of the Board to give a copy of this resolution to Ron Lonneville and the Principal Account Clerk.

Resolution #9112024 Amend Resolution #7142024 Award Contract to Sean Baker, Shores Electric to Install Electric for the New Court Clerk Office

WHEREAS, the Town of Marion sent out an RFP to obtain bids to expand the Court Clerk office; and

WHEREAS, the Town of Marion received 2 bids for the electrical work; and

BE IT RESOLVED, that the Marion Town Board amends Resolution #7142024 to include installing data boxes for computer and credit card access with an amount not to exceed an additional
$560.50 for a total not to exceed $7140.50; and

BE IT FURTHER RESOLVED, the additional $560.50 will be expensed out of account #14104.01.000.040; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Shores Electric and the Principal Account Clerk

Resolution #9122024 Amend Resolution #8162024 Award Contract to Limelight Automotive to Install Window Tint on the Windows Facing Main Street

BE IT RESOLVED, that the Marion Town Board amends Resolution #81162024 to include washing of the outside windows where the tint will be installed with an amount not to exceed an additional $100 for a total not to exceed $856 to be paid by the JCAP Grant to be paid out of
account #16204.01.000.042; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Limelight Automotive and the Principal Account Clerk.

Executive Session:

On a motion from Councilman Cramer and seconded by Councilwoman Herman, the Town Board went into executive session to discuss medical, financial, credit or employment history of a particular person at 7:45pm.

With no further business, on a motion by Councilwoman Herman and seconded by Councilman Cramer, Supervisor Johnson closed the meeting at 8:10pm.
