A Town Board meeting of the Town of Marion, Wayne County, NY was held on
Monday, February 24, 2025 at the Marion Town Court Room.
Supervisor Johnson called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

The following resolution was approved.
BE IT RESOLVED, the Marion Town Board authorizes to set a public hearing for the use of reserve funds to replace the air conditioning at the Marion Public Library; and
BE IT RESOLOVED, that public hearing be held on Monday, March 10, 2025 at 6:30pm in the Marion Court Room located at 3827 North Main Street, Marion, NY at which time anyone for or against may comment; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Library Director, Tracy Whitney.

BE IT RESOLVED, that the Marion Town Board authorizes hiring Morgan Silco for the position of summer recreation leader for the 2025 summer recreation program at a renumeration of $5,000 per grant money stipend for the length of the summer program for 2025 to be expensed from account # 73101.01.0.083; and.
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Morgan Silco and the Principal Account Clerk.
Resolution #213-2025 Accept Resignation of Julie Stryker from Marion Public Library Board

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Julie Stryker, Tracy Whitney and the Principal Account Clerk.
Resolution #214-2025 Accept Resignation of Pricilla Flack from Marion Public Library Board

Resolution #215-2025 Authorize Closing of Streets within the Hamlet for Holiday Parade December 20, 2025

The following resolution was approved.
BE IT RESOLVED, that the Marion Town Board hereby requests the following streets to be fully closed to all traffic on Saturday December 20, 2025 from 5:45p.m. – 7 p.m. The following streets will be open to local holiday parade only.
North Main Street from Park Drive to South Main Street, South Main Street from North Main Street to Mill Street, Newark-Marion/Mill Street from Smith Road to South Main Street; and
BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to E911, Marion Fire Department, Western Wayne Ambulance, Marion Fire District, Seneca Foods, Marion Post Office, Wayne County Highway Department, Wayne County Sheriff, NYS Police Substation, Williamson, Local businesses, Chief Operator WWTP, Nutall – Brad Person, Marion Highway Department, Marion School District and Marion Bus
Resolution #216-2025 Award Contract to Jim Burgio Plumbing to Replace Sink and Faucet at Town Hall

BE IT RESOLVED, that the Marion Town Board awards the contract to Jim Burgio Plumbing LLC to replace the leaking sink and faucet located in the restroom within the town hall to be expensed out of 16204.01.0.042 not to exceed $900; and.
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Jim Burgio Plumbing LLC and the Principal Account Clerk.
Resolution # 217-2025 Authorize a 2025 Budget Amendment to increase Highway Superintendent Seminars Expense Line 50104.01.000.016 by $300 for a total Budgeted Amount of $1200

BE IT RESOLVED, the Marion Town Board authorizes a 2025 Budget Amendment to increase Highway Superintendent Seminars Expense Line 50104.01.000.016 by $300 for a total budgeted Amount of $1200 effective 2/24/25; and
AND BE IT FURTHER RESOLVED, that the Marion Town Board of the Town of Marion authorizes the Clerk to the Board to give a copy of this resolution Highway Superintendent and the Principal Account Clerk.

BE IT RESOLVED, the Marion Town Board Adopts the following Model Rules for Public Access to Meetings:
MODEL RULES
PUBLIC ACCESS TO MEETINGS OF
The Town Of Marion, NY
Section 1 Purpose and scope:
- The people’s right to witness and observe the governmental decision-making process in action is basic to our society. Access to public portions of meetings of public bodies must be protected and maintained.
- We adopt these guidelines in order to provide direction concerning the procedures by which public meetings of this public body may be photographed, recorded and broadcast.
Section 2 Recording and Broadcasting Public Portions of Meetings:
- The public portion of any meeting of a public body may be photographed, recorded and broadcast.
- A public body may adopt reasonable rules governing the location of equipment and personnel used to photograph, record or broadcast the public portion of a meeting in order to ensure that the use of such equipment does not detract from or interfere with the deliberative process.
- There is no privacy interest in statements made during public portions of meetings of public bodies. Distaste or embarrassment shall not constitute a basis for prohibiting or limiting the photographing, recording or broadcasting of those present at a meeting.
Section 3 Rules for Recording and Broadcasting Public Portions of Meetings:
- Operation of equipment to photograph, record or broadcast a meeting is permitted unless it is obtrusive, disruptive, or interferes with the deliberative process or the right of persons in attendance to observe or listen to the proceedings.
- Use of equipment necessary to photograph, record or broadcast is permitted without notice to or express permission from the public body or those in attendance at the meeting.
- Use of equipment necessary to photograph, record or broadcast is permitted in a supervised or unsupervised manner.
- Use of special lighting or large equipment necessary to photograph, record or broadcast a meeting is permitted unless it is obtrusive or disruptive.
- Personnel who operate equipment necessary to photograph, record and/or broadcast a meeting shall be permitted to move about the room, as long as such movement does not disrupt or interfere with the deliberative process.
- Use of equipment necessary to photograph, record and/or broadcast a meeting shall not be limited to a location from which such equipment is not reasonably capable of photographing, recording and/or broadcasting.
- Persons operating equipment necessary to photograph, record and/or broadcast shall be given a reasonable opportunity to modify their actions in order to avoid interference with the deliberative process.
Section 4 Public notice:
These rules governing the operation of equipment necessary to photograph, record or broadcast a meeting shall be posted in a designated location. Written copies of such rules shall be provided upon request, free of charge, to those in attendance at or who seek to attend a meeting.
Section 5 Severability:
If any provision of these guidelines or the application thereof to any person or circumstances is adjudged invalid by a court of competent jurisdiction, such judgment shall not affect or impair the validity of the other provisions of these regulations or the application thereof to other persons and circumstances.
AND BE IT FURTHER RESOLVED, that the Marion Town Board of the Town of Marion authorizes
the Clerk to the Board to give a copy of this resolution to all Town Board members.

On a motion from Councilwoman Herman and seconded by Councilman Cramer, the Town Board entered into executive session to discuss a personal issue at 7:25pmpm. The Board closed executive session at 7:27pm
The Town Board opened the meeting back up and spoke with Baseball/Softball coordinator, Justin Minier.
With no further business, on a motion by Councilwoman Herman and seconded by Councilman Lonneville, Supervisor Johnson closed the meeting at 7:38pm.
